SHANE GIBSON'S SECOND CONTRACT SIGNED THE SAME DAY AS THE OTHER

Shane Gibson has two contracts he signed and is currently operating under.  Below is the second one:

The following reflects what this document states:



AGREEMENT FOR SERVICES

     This Agreement for Services (this "Agreement") is made and entered

this 13 day of January, 2012, by and between Shane L. Gibson d/b/a

Gibson Law Office, LLC (the "Gibson"),  and the Sewer and Storm

Water Utilities for the City of New Albany (hereafter referred to

as "Utilities").  Gibson and City agree as follows:

     1.  Gibson is an independent contractor for the City with

          respect to the Sewer Utility and the Storm Water

         Utility and shall be paid $3,750.00 per month.


     2.  Gibson's duties and responsibilities shall include, but not

          limited to, attendance at respective board meetings for the

          Sewer and Storm Water Utilities, research legal issues

          and render legal opinions, and draft legal documents for

          said department, and any other activity requested by the

          Board and/or the City Attorney.


     3.  Gibson shall be paid the retainer fee per month, which

          retainer shall fully compensate Gibson for the first fifteen

          (15) hours of legal work each month.  In addition, Gibson

          shall be paid an hourly rate of $150.00 for any work

          performed in excess of fifteen (15) per month for any

          work beyond the scope of his duties and responsibilities

          as described herein above.  The hourly rate shall apply to

          the involvement in any litigation, or any other legal

          matters agreed by the parties.

more rip offs, no attorney is worth that for being in attendance at a sewer board and storm water board meeting. Gahan is a bigger fool and idiot than england ever was and when the EPA hammers the city for the sewers again that party boy wont have a clue what to do

There is a better way. Lawyers and bar associations have recently turned to alternative, non hourly based, fee arrangements. They are usually based upon a flat fee or monthly retainer fee for all services regardless of time, or set fee for each increment of the legal service. The city would be well advised to abandon its insistence on the hourly billing and negotiate for other, more reasonable, forms of professional compensation.

1:55, You would need to review claims through whichever Board he submits them through. I'm sure there would be claims under each board he has been hired to represent.

Amen. If we dumped this stupid "billable hours" routine and if they'd stop pretending Gibson's a "contract employee" as opposed to a "city employee" and therefore able to be listed with the rest of the city employees when they tell who makes the most money and so on, then maybe there'd begin to be some transparancy here. Why that stupid Baylor's not all over this is beyond me. Oh, wait, yes, he's convinced himself that that dope is a PROGRESSIVE, like him. ROFLMFAO

If Gibson is a contracted employee for the city, why is he able to be on city insurance. Wow what a perk. Police and Fire employees have to report to work every day and put their life on the line to have the same insurance a contracted employee will be able to have who make's a lot more money and does a lot less work. What a rip off. And sit's behind a desk. Only in America

6:49 AM - My husband worked his whole life as a contractural employee where corporate always outsourced the work. He made good money because he had to pay for our insurance and other things. He sure didn't get these kind of perks. What a crock.

Shane Gibson is making $75,000 for "working" 40 hours a MONTH. 40 hours a month, people. 40 hours. That's only if he has to work them consecutively and cannot log them concurrently. Otherwise, it's back to a 25-hour-a-month workload.

And this doesn't bother Baylor, who was all over Susan Kaempfer, one bit? A bit disingenuous favoritism on Baylor's part if you ask me.

40 hours a m-o-n-t-h. And he's a lousy attorney. Wow.

Perhaps you all didn't read that quite right. Yes, he can "Participate" in the cities insurance, but he SHALL PAY the costs associated with any participation. Our tax money does not cover his insurance, he has to pay for it himself. The only advantage he gets is not having to look for new insurance.

I know at first glance I thought the same as you, but was in total disbelief so I read it again.

8:14 Are you sure ? I checked with a friend of mine that works for the city and she told me that any participation may mean he pays what all other employees pay. She said that is 10% of the cost and the city picks up the rest.

Don't know about how much he paid, but I did find out what number he was in his graduating class.

Shane was propped up all the way through college and law school.

Oh, and there's one other thing. I was there when a certain group plucked Shane out of a group of young people to hone and make one of their next batch of golden boys. Why didn't they pick the smarter brother? Well, you might not know, but I do. I was there and I know how the whole thing started. They created this monster and have kept him going right along with their myth that he's the next generation of golden rulers of NA.

What I want to see is the executive order recending Doug England's Executive Order on the Insurance to ALL VESTED non-bargaining employees that they would be entitled to receive when they leave the cities employment. I was told it was done but the mayor seems to be too busy, or his secretary keeps out people that want to ask the mayor questions concerning the dismissal of certain employees.

Whatever the cost, Shane is worth every bit of it. He is an outstanding lawyer who gives his all for the betterment of our community. I'm glad that his efforts are being recognized, and that he is getting his just rewards for all of the time and expertise that he puts in. You complainers are just jeolous. Grow up.

P.S. I remember that Shane wouldn't give me the time of day. Until he ran for office. Then, he was in my office, smiling at me and calling me by name and making sure to stop in "just to say hello" to me, his suddenly great friend.

The 'truth' doesn't bother me...the 'truth' is the two contracts, which are right there in black and white. I have no problem with either of them.

It's all of the 'well I heard...' 'Well I think..' that all of you here represent as truth that bothers me.

I've never met Shane in my life, and I couldn't begin to say anything about his moral character. The posters here- you all show your true, ugly colors daily.

I agree. This is getting boring. Let's talk about some real criminal spending of tax payer dollars. Like the Prosecutor using our money to cover his personal legal fees. Now there's a greedy bas...you-know-what. And now we have to continue paying him, but also some other attorney to try the Camm Case AGAIN. All because he thought he could get rich off of other people's pain by writing a book.

After reading todays Tribune on line, would someone tell me why Shane Gibson is writing parks ordinance? Why are we paying Robinson and Lorch? Who is the City Attorney? Does this fall under billable hours?

I think that there are a lot more things to consider that go into these contracts than just their face value. It's easy to take one sheet of paper, or one fact, and make a story around it- hell, look at the media these days. That's all the stories really are.

While I do want my government to spend my money responsibly, I also full well know that all of us have different opinions on what is considered money well spent. If there wasn't, there'd be no political divides.

What penalties/fees were avoided by having attorneys in various positions? Could there possibly be reasons that people here aren't aware of to do one thing or another within government? I'm saying there's much more to it, and folks around this blog like to hint around at just about everyone's lack of character, with no evidence other than their own grumblings or perceived 'wrongs'.

Perhaps there HAS been illegal dealings. But, just saying it here doesn't make it so, though many of the posters would like that to be the case.

Also, am I a progressive? I don't know. At Dictionary.com, I found the definition of 'progressive'- :favoring or advocating progress, change, improvement, or reform, as opposed to wishing to maintain things as they are, especially in political matters.

Yeah, I guess I AM a progressive.

My question is, why are we paying a sub-par attorney for ANY job in New Albany? Gibson messed up my sister big time. He's incompetent. End of conversation. I don't care if I'm a Democrat or Progressive or what, I don't have to agree that he's doing a good job because I don't.

Shane seems like a pretty good guy to me. I don't know him well. I can't say if he is a good lawyer or not, because I'm not a lawyer and I have no way of knowing. I say give him the benefit of the doubt. It is too easy for people to get on here and make anonymous allegations without any basis.
